Jeremy P. Blumenfeld represents defendants on a range of employee benefit litigation matters, including numerous Employee Retirement Income Security Act (ERISA) class actions. Co-chair of the firm’s ERISA litigation practice, Jeremy defends class action claims challenging the investments, recordkeeping, and use of forfeitures in 401(k) and 403(b) savings plans, benefit calculations and related disclosures in cash balance plans, “actuarial equivalence” and other pension calculations matters, health plan litigation, including regarding prescription drug pricing and “tobacco surcharge” litigation, as well as litigation regarding employee stock ownership plans (ESOPs) and traditional severance pay plans. He also advises clients on litigation and risk avoidance.
Colleagues have dubbed him a thought leader for his client-centric approach in challenging ESOPs, defined benefits plans, cash balance plan design, disclosure, and the legal challenges presented by “whipsaw” claims. He often speaks to a variety of audiences on employee benefits topics and ERISA litigation.
