White House Zooms In on Hospital Contracts, Healthcare Financial Management Association

Healthcare Financial Management Association quoted partner Zachary Johns in an article examining increased federal scrutiny of hospital contract provisions that the administration says contribute to higher healthcare costs.

The article discusses how a recent White House memo and ongoing US Department of Justice (DOJ) enforcement efforts could lead to additional legal challenges involving anti-steering, anti-tiering, and related contract provisions. Zak emphasized the importance of proactive compliance, advising health systems to evaluate whether their contracting practices resemble those challenged by the DOJ.

“If I were in a health system, I would be turning around and saying, ‘Are we doing something that’s like this, because this is what the DOJ is most focused on,’” Zak said.

He also underscored the value of contemporaneous documentation during negotiations, noting, “The overall takeaway from all of this is your documentation in real time is so important.”
