What EPA’s Continued Defense of PFAS Rule Means for Cos., Law360
2025年10月21日Partners Matthew Thurlow and Stephanie Feingold and associate Drew Cleary Jordan coauthored an Expert Analysis article for Law360 discussing the recent decision from the US Environmental Protection Agency (EPA) to continue defending the designation of certain per- and polyfluoroalkyl substances (PFAS) as hazardous substances under the Comprehensive Environmental Response Compensation and Liability Act (CERCLA), also known as the Superfund law.
The authors review the original rulemaking on perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS), the current litigation against the designations, related regulatory decisions on PFAS, and what these developments mean for future EPA regulation and enforcement under CERCLA.
