Manita Rawat, a registered patent attorney with the US Patent and Trademark Office (USPTO), maintains a thriving intellectual property (IP) practice that includes serving as lead outside patent counsel to Fortune 100 companies in Silicon Valley. She primarily supports large technology companies with managing their domestic and foreign patent portfolios, which includes determining patentability and drafting and prosecuting patent applications to allowance. Manita also has experience with USPTO post-grant proceedings, including inter partes review and reexamination. She is the managing partner of the firm’s Silicon Valley office.

Manita has a strong technical background in applied mathematics, with concentrations in computer science, aerospace engineering, and statistical analysis, as well as a strong foundation in biochemistry. She represents leading technology companies developing cutting-edge innovations in artificial intelligence (AI), generative AI, large language models (LLMs), machine learning, cloud computing, data center infrastructure, distributed computing, enterprise software, cybersecurity, networking, mobile applications, and digital platforms.

Drawing on her interdisciplinary technical background, Manita advises clients on sophisticated patent strategies for complex software and AI technologies, including innovations involving AI infrastructure, data center architectures, accelerated computing, and scalable computing environments. She has experience navigating the unique patentability issues presented by computer-implemented inventions, including subject matter eligibility under 35 USC § 101, and develops practical prosecution strategies that maximize patent protection while achieving efficient, cost-effective outcomes before the USPTO.

Manita also advises clients on the IP aspects of corporate transactions, including mergers and acquisitions, strategic investments, and financing transactions. Her experience includes conducting IP due diligence, evaluating patent and trademark portfolios, reviewing licensing agreements, assessing litigation risks, and performing freedom-to-operate analyses. She also counsels clients on patent licensing and other commercial transactions, including structuring, negotiating, and drafting complex IP agreements.

In addition, Manita provides technical and strategic support in patent litigation involving software, AI, and other advanced technologies. She assists clients in developing infringement, noninfringement, invalidity, and claim construction positions, drafts claim construction and dispositive briefs, prepares technical experts, and has argued motions relating to patent invalidity.

Prior to joining Morgan Lewis, Manita served as managing partner of the Silicon Valley office of another global law firm.
