Rocketing Patriotism in Promoting ‘Made in USA’ Risks FTC’s Red Glare, Corporate Counsel

Corporate Counsel spoke with partner Daniel Savrin and associate Caitlin Zeytoonian for an article examining the heightened Federal Trade Commission (FTC) enforcement of “Made in USA” claims following an executive order directing agencies to prioritize enforcement of US-origin labeling requirements.

Caitlin highlighted the alignment between the administration’s priorities and the FTC’s enforcement agenda, stating, “This is an issue in particular that aligns with executive priorities, and the agency (FTC) is well-positioned to push this forward.”

Daniel noted that many products do not meet the FTC’s stringent standard, explaining, “There are very few products that actually would qualify for the Made in USA classification,” adding, “If you are assembling in the U.S., that does not necessarily qualify you to use ‘Made in USA.’”
