Phillip Wolfe focuses his practice primarily on representing clients in complex patent, trademark, and trade secret disputes. Utilizing his engineering experience and enthusiasm for client services, Phil regularly appears before US federal district and appellate courts, the US Court of Federal Claims, and the US International Trade Commission. Phil handles all phases of litigation, from inception through trial and post-trial appeals. Additionally, he advises clients on intellectual property strategy, ranging from small businesses with no established IP program to Fortune 500 companies.
Phil has played a central part in numerous patent litigation matters regarding a wide spectrum of technologies. He has experience handling all stages of litigation, including pleadings, fact and expert discovery, dispositive motion practice, trial, and appeal. Phil also utilizes his patent prosecution experience to formulate his litigation strategies for clients.
Phil also leverages his patent litigation experience in guiding clients through patent prosecution, mindful of potential enforcement and defense efforts that clients may engage in later. He advises clients at all stages of prosecution, from invention disclosure through appeal to the Patent Trial and Appeal Board, and continuation practice to obtain broad coverage. His practice includes a wide variety of technologies, including traditional mechanical inventions and systems, inventions related to telecommunications, and inventions utilizing artificial intelligence and machine learning.
Phil has spoken on topics including the intersection of intellectual property and antitrust, artificial intelligence as an inventor, and inequitable conduct before the US Patent and Trademark Office. Phil currently vice chairs the American Intellectual Property Law Association’s (AIPLA) IP Practice in Israel Committee where he works to establish and maintain relations with IP associations in Israel, in addition to studying and reporting on issues of interest to the AIPLA Board of Directors and membership.
Phil also maintains an active pro bono practice, representing clients as part of the Eastern District of Pennsylvania’s Prisoner Civil Right panel, and representing qualifying small businesses through Philadelphia Volunteer Lawyers for the Arts to protect their intellectual property rights.
