Theory became reality on Friday, April 5 when a jury returned a verdict in the SEC’s favor in SEC v. Panuwat, a first-of-its-kind action against “shadow trading”—a novel theory of insider trading involving transactions in stocks of issuers in the same industry or sector of a company about which the trader allegedly has insider information.
The outcome of SEC v. Panuwat is likely to have a widespread and substantial impact on the marketplace.
