ESG Regulatory Regimes: Navigating Competing Jurisdictions

Join us as we explore ESG legislation across multiple jurisdictions and the challenges of navigating conflicting regulatory requirements. We will discuss the anticipated actions of the new Trump-Vance administration as well as the implementation of regulations including California’s new climate disclosure laws and EU ESG directives. The session will also cover the potential use of antitrust laws to address alleged collusion in ESG/diversity, equity, and inclusion (DEI) activities.

Topics Will Include:

  • California: Overview of AB 1305 (effective January 1, 2025) requiring disclosure from businesses involved in carbon offsets or making net-zero claims. We will also address two other California climate disclosure laws, the Climate Corporate Data Accountability Act and Climate-Related Financial Risk Act
  • European Union: Analysis of the EU’s Corporate Sustainability Reporting Directive (CSRD) and the Corporate Sustainability Due Diligence Directive (CSDDD) for multinational companies
  • United Kingdom: ESG reporting requirements and key considerations
  • US Public Companies: ESG reporting requirements and key considerations for publicly traded companies, including updates from Carl Valenstein
  • Antitrust: Examining the potential weaponization of antitrust laws against ESG/DEI practices, with Amanda Robinson discussing likely congressional investigations and the impact on companies’ ESG disclosures, particularly under the CSRD
