Prediction Market Law Keeps Veering, Inviting Supreme Court (1) Bloomberg Law

Bloomberg Law quoted partners Stacie Hartman and Rob Schwartz in an article about a circuit split over whether sports prediction markets fall exclusively under federal commodities regulation or may also be regulated by states as gambling. 

“This decision reflects the zig-zag of rulings on this space, given the early win by Kalshi before a reversal by the same judge in the same lower court,” Stacie said. Rob added, “We now have a circuit split on exactly that question, and the Supreme Court will have to intervene.”
