First Reading of China’s Anti-Cross-Border Corruption Law, Global Relay Intelligence & Practice

Partner Bingna Guo, of counsel Bing (Rose) Le, and associate Yijie (Selina) Bao co-authored an article for Global Relay Intelligence & Practice about China’s draft Anti-Cross-Border Corruption Law and its potential implications for companies with international operations. 

The authors explained that the proposed law would broaden the scope of China’s cross-border anti-corruption regime and establish corporate compliance obligations, including risk assessments, internal reporting mechanisms, third-party due diligence, and potential mandatory reporting of suspected cross-border corruption. They noted that companies based in China and those operating in or with China should monitor the draft legislation and assess whether their anti-corruption compliance programs may need to adapt to the developing requirements.
