Morgan Lewis partner Christine Lombardo was quoted by Hedge Fund Law Report in an article about the US Securities and Exchange Commission’s (SEC’s) modernized marketing rule. The new single “Marketing Rule” replaces the current Cash Solicitation Rule and Advertising Rule.
According to the article, some were surprised that the SEC chose to combine the rules. Speaking to Hedge Fund Law Report, Christine said “The reason the SEC staff indicated that they did that was because solicitation activities do have an inherent marketing aspect. I agree that solicitation and referral activities are forms of marketing, so that makes sense to me – but the creation of one rule was still surprising.”
