The SEC Has Contingencies After Supreme Court Loss, FTF News

Jarkesy on the Securities and Exchange Commission’s (SEC’s) enforcement authority.

Drawing from the LawFlash, the article notes that many respondents to SEC actions “challenged the constitutionality of the SEC’s administrative proceedings in federal court. To avoid such challenges, for years, the SEC’s practice has been to pursue securities fraud cases in federal court. The Jarkesy decision is likely to make that practice permanent.”
