Partner John Hemmer spoke with MLex for an article about the US Patent and Trademark Office’s (USPTO’s) new AI tool, DesignVision, which lets examiners search image-based prior art across global databases, likely prompting agents to adjust design patent prosecution strategies.
For example, John suggested “potentially doing some searching up front before filing to make sure that the design is actually novel and nonobvious,” adding that it’s “something that happens occasionally on the utility side, but because of the investment and timing, rarely happens on the design side.”
