EPA Questions on Key TSCA Terms’ Definitions Could Narrow Evaluations, Inside EPA

In its proposal, the EPA said that certain aspects of the Biden-era framework rule, including the requirement to evaluate all conditions of use, could negatively impact the agency’s ability to complete risk evaluations in a timely manner. Quoting from the LawFlash, the article notes that removing the requirement to evaluate all uses “restores EPA’s discretion to focus on uses most likely to drive risk, helping to speed up evaluations and reduce the time spent on low-risk or peripheral uses, while giving industry greater clarity about what will be in scope.”
