USPTO Has Eye on New Tech in Design Patent Guidance, Law360

Partner John Hemmer was quoted by Law360 in an article about the US Patent and Trademark Office’s (USPTO’s) expanded guidance on design patents for computer-generated images, including those used in virtual reality, holograms, and similar technologies.

John told the publication that, despite the USPTO’s updated guidance, practitioners are likely to continue certain legacy drafting approaches to preserve flexibility across jurisdictions and potential future rule changes.

“I think a lot of folks, including myself, will continue to use the display panel in broken lines around most [graphical user interfaces] where it makes sense to and where we had in the past, in case the rule changes again or for foreign filing purposes,” John said.
