DOL Amendment Formally Restores 2019 Overtime Exemption Rules, SHRM
May 18, 2026SHRM quoted partners Russell Bruch and Eric Kim in an article discussing the US Department of Labor’s (DOL’s) amendment revising regulations issued under the Fair Labor Standards Act implementing the exemptions from minimum wage and overtime pay requirements for executive, administrative, professional, outside sales, and computer employees.
Russell noted that employers must continue monitoring state law requirements that may impose higher salary thresholds or different duties tests than federal law. “Indeed, the DOL’s action has no effect on state law overtime exemptions, so employers will need to continue complying with all requirements under those laws,” Russell said. Eric added that employers should continue conducting exemption audits and monitoring federal and state developments. “Employers should continue evaluating classifications holistically, documenting exemption analyses, training managers on overtime compliance, and watching for additional federal or state developments in this area,” Eric said.
