Morgan Lewis’s High Court Win on Standard Essential Patents Recognized as Impact Case of the Year by Managing IP

LONDON, May 7, 2026: Morgan Lewis’s standard essential patent (SEP) win in the High Court of England and Wales on behalf of clients Acer and Asus was recognized as an Impact Case of the Year by Managing IP at their annual EMEA Awards. The award honors IP disputes that made a significant impact in a given jurisdiction or region.

The high-profile global dispute with Nokia concerned SEPs for video streaming technology. Following trial, the court issued the first substantive ruling confirming that reasonable and non-discriminatory (RAND) licensing undertakings covering the H.264 and H.265 standards are contractually binding and enforceable by implementers.

With parallel proceedings ongoing in multiple countries, the judgment marked the first time the court determined the scope of RAND undertakings given by SEP holders to the International ITU-T Standard Setting Organization for video codec standards.
