This presentation by the data analytics and governance team will examine how long-standing doctrines of attorney-client privilege and attorney work product apply in the rapidly evolving context of generative AI.
The discussion will address key questions lawyers face when using AI tools in litigation, investigations, transactions, and client counseling, including how prompts, outputs, training data, internal analyses, and AI-assisted drafts may be treated in discovery; what steps may help preserve privilege and work-product protections; and how courts, regulators, clients, and opposing parties may scrutinize the use of generative AI in legal practice. The program will offer practical guidance for evaluating risk, documenting appropriate safeguards, and integrating generative AI into legal workflows while protecting confidential client information and litigation strategy.
