Human Authorship Is Still Central to Copyright Eligibility, Law360

Kilduff co-authored an Expert Analysis article for Law360 examining the continued requirement of human authorship for copyright protection following the US Supreme Court’s denial of certiorari in Thaler v. Perlmutter.
The authors analyze how the decision reinforces longstanding Copyright Office guidance and case law requiring human creative control, even where artificial intelligence (AI) is used as a tool. The article also highlights practical steps for companies, including documenting human contributions and reviewing internal policies, to strengthen copyright claims in AI-assisted content.
