In addition to the changes in the criteria for discretionary denial in IPR and its impact on practice, we will also discuss the trend of the Domestic Industry Requirement, which is being interpreted in an expansive manner by the ITC and explain the issues that domestic companies should be aware of with the latest precedents and practical examples.
In this extra installment of Better Safe Than Sorry, Alexander Ritter, a patent lawyer from our Munich office and Makoto Hattori, an attorney and patent attorney from Abe, Ikubo & Katayama Law Firm, will present a special seminar focusing on how to defend against standard essential patent (SEP) assertions in Europe and Japan.
In the fourth session of Better Safe Than Sorry in 2025, we will provide an overview of the basic concepts, rules, and special considerations related to the requirements for written description and enablement under Section 112 of US patent law, followed by a detailed explanation of practical considerations using concrete examples.
From strategic planning during the pre-trial phase, selecting persuasive witnesses, conducting cross-examination, to analyzing jury deliberations—this seminar will provide practical and insightful content for any company facing US patent litigation.
The third session of our Better Safe Than Sorry 2025 series will focus on deposition. Following the seminar, as a special benefit for attendees at the live venue, we will offer the “Mock Deposition” as well as a lecture by TMI Patent Attorney Takashi Nakajima on “Generative AI and Intellectual Property.”
The session will focus on Important IP Cases of 2024, offering a quick review of the main points of important US patent litigation cases decided by the US Supreme Court and the US Court of Appeals for the Federal Circuit in 2024, and how these cases affect the ordinary practice of law. The presentation will also explore how the precedents will affect the ordinary practice.
